Franchising Commercial Litigation and Dispute Resolution
Represented a leading U.S.-based multi-unit franchise operator on resolving various disputes with a franchisor and resolving issues related to COVID-19 and rent relief with numerous landlords. The disputes with the franchisor escalated to a federal lawsuit to resolve numerous claims related to fraudulent inducement; negligent misrepresentation; breach of contract; Florida Deceptive and Unfair Trade Practices Act; Florida Franchise Act; and various other statutory causes of action. The disputes with various landlords over COVID-19 and rent relief escalated into state court litigation.
Represented a client in resolving various disputes with franchisees in Florida and Arizona over issues involving system standards, training, system support, and royalties. Several matters involved resolving disputes that resulted in the master franchisee terminating the franchise agreements of various franchisees for breach of contract and abandonment of the franchise business.
Represented a franchisee in an action against franchisor for (1) declaratory judgment; (2) breach of contract; and (3) breach of the duty of good faith and fair dealing related to the franchisor’s failure to enforce the territorial benefits provided to the franchisee in the franchise documents.
